What can I do when my case was thrown out of court without even being heard?
My partner and myself were having trouble with a neighbour living below us,(loud parties, hammering and drilling at unreasonable hours, and loud parties). In the court the so-called judge kept adjourning the case for several months before just throwing the case out without even hearing it. What can we do now? P.S. We have had to move because we could not put up with this disturbance any longer and now they are all telling us we don't have a case any more. Someone please help or suggest where we can get help on this matter in Ireland
Your question was posted in the U.S.A. section so I don't know how helpful my response (which is based on American laws) will be, but in my country your lawsuit would be dismissed on the basis of mootness.
A lawsuit becomes moot when the reason for the lawsuit ends. Once you moved, your downstairs neighbor lost his ability to disturb you so there is no potential for future damages. I'm curious as to what type of lawsuit you filed. If you were asking for damages based on the lack of habitability of the residence during the time you lived there, then this part of the lawsuit would still be "ripe."
