How do I sue my employer and my Union, I was assaulted by a coworker, he hit me on the hard hat with a?
22 oz framing hammer. It dropped me to my knees and jarred my neck and my jaw is out of whack now too. I filed a formal complaint and nothing was ever done. I tried to charge him with the RCMP but the only witness I have will not come forward.I worked for this company for 18 yrs. and I think they were trying to get rid of me because of my age. After I complained to my Union, the company brought in investigators and they found enough evidence to confirm harassment, sexual harrasment, abuse of authority and yet my Union will do nothing about it. I ended up quitting and was wondering if I have enough cause to sue the company and maybe the Union for mis-representation. For 18 yrs. of my life I was committed to that company and I'm mad as hell. If anyone has any advice for me I would surely appreciate it. I live in Alberta, Canada and I really can't afford a lawyer, but if someone were to help me sue them I would give a percentage. Thanks in advance.
I don't know if you have Legal Aid available in Canada. In the United States, there are legal aid services where lawyers will work on cases pro-bono (without charge) as part of their service to the state or area they are licensed to practice in.
I do not know if you have a viable case without any witnesses, but that would be for the lawyer and the court system in Canada to decide.
In the United States the witness could be served papers by the court and would have to come forward. They would find themselves in contempt of court and thrown in jail or fined if they did not cooperate.
You may want to see if that can take place in Canada.
